IBM Strikes Back

That thud you heard was the other shoe officially dropping. IBM has filed a countersuit against SCO. They claim that a) SCO can't claim ownership when they released the code under the GPL, b) that SCO interfered with IBM's business by attacking AIX, and c) that SCO is in violation of four IBM patents. While I am least thrilled about the last charge, it is the one that is most likely to cause some action. Here's a snip from that article:

The patent claims will be expensive to handle, said Brian Ferguson, an attorney with McDermott, Will & Emery. "That's a real smart move by IBM," he said. "I think that alone could cause some kind of early settlement negotiations that are going to really swing the pendulum around in IBM's favor--or at least to a situation of equipoise."

SCO is either going to have to settle or potentially run themselves into the ground fighting the suit. Dare I say, "Haha!" In a related story, News.com.com.com.com has an interview with Red Hat's Matthew Szulik about their recent suit against SCO. Thanks Slashdot.
